PointShot, Inc. (“PointShot,” “we,” “us,” or “our”) operates an online marketplace platform that connects athletes with sport coaches and specialists (the “Service”). The Service is available through our website at https://www.pointshot.com and related applications and tools.

This Privacy Policy explains how we collect, use, disclose, and safeguard personal information about you when you access or use the Service, including when you create an account, upload videos or files, purchase products or services through checkout, communicate with other users, or otherwise interact with us.

This Privacy Policy applies to individuals who use the Service as athletes, parents or legal guardians of athletes, coaches or specialists, and visitors to our website.

Service availability. The Service is offered from and intended for use by individuals in the United States. See Section 14 for more information.

By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our policies and practices, please do not use the Service.

We collect information in three general ways: information you provide directly to us, information we collect automatically when you use the Service, and information we receive from third parties.

Account and profile information. When you register for an account, we collect information such as your name, email address, phone number, password, date of birth, postal or billing address, profile photo, biographical information, and any other information you choose to include in your profile.

Athlete information. If you use the Service as an athlete (or as a parent or guardian on behalf of an athlete), we may collect athletic background and experience, performance data and metrics, position and sport information, team affiliations, nutrition and strength training plans, ratings and reviews, and communications with coaches or specialists regarding training, performance, and health.

Coach and specialist information. If you use the Service as a coach or specialist, we may collect professional certifications and qualifications, coaching experience and specializations, identity and eligibility verification information, tax and payout information required to receive payments (collected and processed by Stripe under Stripe Connect), ratings and reviews from athletes, and feedback and evaluations you provide. To help verify that coaches and specialists are appropriately certified and SafeSport compliant, we may look up or verify your credentials using publicly available certification-lookup tools maintained by governing bodies such as USA Hockey and Hockey Canada, and we may record the results of those lookups.

Content you submit. We collect content you create, upload, post, send, or share through the Service, including videos, images, documents, messages, comments, reviews, ratings, and other uploaded files (see Section 5 for more information on uploaded content).

Payment and transaction information. When you make a purchase through our checkout, we collect information necessary to process the transaction, including billing name and address, the product or service purchased, and limited payment details. Full payment card numbers and other sensitive payment credentials are collected and processed by our payment processor (Stripe), not by PointShot (see Section 6).

Communications. We collect the contents of messages you send through the Service, emails and other communications you send to us (including customer support inquiries), and your marketing preferences.

Parental information and parent-administered accounts. For athletes under 18, we collect information about a parent or legal guardian, including the parent’s name, email address, phone number, relationship to the athlete, emergency contact details, and any billing or payment information used to pay for services on the athlete’s behalf. Parents with administrative access to a minor athlete’s account can manage the account, make purchases, and upload videos and other content on behalf of the athlete; in those cases, we collect and associate both the parent’s and the athlete’s information with the account and the activity. A parent may remain connected to an athlete’s account after the athlete turns 18 only where the now-adult athlete permits it through in-product controls; the adult athlete can end that connection at any time. See Section 13 for more detail.

When you access or use the Service, we and our service providers automatically collect certain information about your device and your use of the Service, including:

  • Device and technical information: IP address, device identifiers, browser type and version, operating system, referring URLs, language settings, and time-zone information.
  • Usage information: pages and screens you view, features you use, buttons and links you click, search queries, time spent on the Service, and dates and times of access.
  • Location information: approximate location derived from IP address, and more precise location data that you choose to provide (for example, town/state in your profile).
  • Log and diagnostic data: crash reports, performance data, and error logs.
  • Cookies and similar technologies: see Section 7.

To protect the Service from spam, abuse, and automated attacks, we use Cloudflare Turnstile, a privacy-focused security verification service. When you submit forms or perform certain actions, Turnstile may collect browser and device characteristics, interaction patterns and behavioral signals, network information and IP address, and challenge response data. Cloudflare processes this information to verify that you are a legitimate user and not an automated bot. Cloudflare’s privacy policy governs Cloudflare’s processing of this data.

We may receive information about you from third parties, including:

  • Teams or programs that add you to a roster or invite you to the Service.
  • Coaches, specialists, or other users who reference you in communications, reviews, or records on the Service.
  • Certification and verification sources, including governing bodies such as USA Hockey and Hockey Canada and any lookup tools they provide, used to verify coach or specialist credentials.
  • Our payment processor (Stripe), which provides us with limited information about your transactions and payouts.
  • Social media platforms, if you choose to connect or sign in through them, subject to your settings on those platforms.
  • Publicly available sources and third-party data providers.

We use the information we collect for the following purposes.

  • Create, maintain, and secure user accounts and profiles.
  • Facilitate connections between athletes, coaches, and specialists.
  • Enable messaging, reviews, ratings, scheduling, and other platform features.
  • Process uploaded videos and files and make them available as described in Section 5.
  • Process checkout, payments, refunds, payouts, and related transactions (see Section 6).
  • Provide customer support and respond to your inquiries.
  • Understand how users interact with the Service to diagnose issues, measure performance, and improve usability.
  • Develop new products, features, and services.
  • Conduct research, analytics, testing, and internal product development.
  • Generate aggregated or de-identified information for analytical, business, and other purposes; such information does not identify you and may be used and disclosed without restriction.

3.3 Safety, Security, and Fraud Prevention

Section titled “3.3 Safety, Security, and Fraud Prevention”
  • Verify identities and review certifications of coaches and specialists, including by consulting certification-lookup tools maintained by governing bodies such as USA Hockey and Hockey Canada, for purposes of evaluating coaching eligibility and SafeSport compliance.
  • Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity.
  • Verify that users are legitimate humans and not automated bots (via Cloudflare Turnstile).
  • Moderate content and user conduct on the Service, including suspending or terminating accounts for abuse or policy violations (the data-retention consequences of account termination are described in Section 8; the full rules governing suspension, termination, and appeals are set out in our Terms of Service).
  • Enforce our Terms of Service and other agreements.
  • Protect the rights, property, and safety of PointShot, our users, and others.
  • Send transactional messages such as account notifications, confirmations, receipts, and service updates (delivered through our transactional email provider, Mailgun).
  • Send marketing communications about PointShot products, features, and promotions, where permitted by law (delivered through our marketing email provider, Brevo). You may opt out at any time (see Section 10.4).
  • Invite you to participate in surveys, promotions, and research.
  • Comply with applicable laws, regulations, court orders, and other legal processes.
  • Respond to lawful requests from public authorities.
  • Establish, exercise, or defend legal claims.
  • Meet tax, accounting, recordkeeping, and reporting obligations (including tax reporting performed by Stripe for coaches and specialists, such as issuance of IRS Form 1099).

We will not use your personal information for materially new purposes that are incompatible with those described in this Privacy Policy without providing notice and, where required by law, obtaining your consent.

We share personal information only as described below. We do not sell personal information for money. Some sharing of personal information for analytics or advertising may, however, be considered a “sale” or “share” under certain U.S. state laws; see Sections 11 and 12 for more detail and for your opt-out rights.

To facilitate the marketplace, we share information with other users, including:

  • Public or semi-public profile information such as name, photo, bio, ratings, and reviews (subject to visibility restrictions for athletes under 13 — see Section 13).
  • Performance data, videos, and evaluations relevant to active coaching relationships.
  • Messages and communications you send through the Service.
  • Team rosters and affiliations.

You can control certain profile information through your account settings.

  • Enforce our Terms of Service and other agreements, and investigate potential violations.

If PointShot is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, or sale or transfer of some or all of its assets, your information may be disclosed or transferred as part of the due diligence or transaction. We will notify you (for example, by email or a prominent notice on the Service) of any resulting change in ownership or use of your personal information, as well as any choices you may have regarding your information.

Section titled “4.6 With Your Consent or at Your Direction”

We may share your information for other purposes when you have given us your consent or direction to do so.

4.7 Aggregated or De-Identified Information

Section titled “4.7 Aggregated or De-Identified Information”

We may share aggregated or de-identified information that cannot reasonably be used to identify you for any purpose, including research, analytics, marketing, and business development. Where required by law, we maintain and use de-identified information without attempting to re-identify it.

The Service allows you to upload, store, and share videos and other files. Examples include videos of athletic performance, training sessions, and coaching feedback; profile photos and avatars; and documents such as development plans, nutrition plans, strength and conditioning plans, and reference materials shared between athletes and specialists (collectively, “User Content”). User Content may include, without limitation, video files, image files, PDFs, and word-processing documents.

What we collect. When you upload User Content, we collect the file itself and associated metadata, which may include the filename, file size and format, duration and resolution (for videos and images), upload timestamp, and technical information necessary to process, store, and deliver the file. We may also collect any descriptions, captions, titles, or tags you add.

How we store it. User Content is stored using our cloud hosting and storage provider (Amazon Web Services). We take commercially reasonable steps to protect User Content in transit and at rest, including encryption where technically appropriate.

Who can see it. Visibility of User Content depends on where and how you post it on the Service. Some content may be visible only to you (for example, private drafts in our video editor), while other content may be shared with specific recipients (such as a coach you are working with) or, if you choose, be visible more broadly on your public profile. Please review the sharing controls and context before uploading. Athletes under 13 do not have publicly visible profiles (see Section 13). Coaches, specialists, and other users to whom you share User Content may retain copies, screenshots, or derivatives of it outside of the Service.

How we use it. We process User Content and related metadata to provide the Service — for example, to enable playback, preview, and in-product editing (including our video editor), to generate thumbnails, to support search, and to deliver content to intended recipients. We may also use aggregated or de-identified information about upload and usage volumes for analytics and service improvement. We do not use your User Content to train third-party generative AI models. If we ever introduce features that use User Content to train our own machine-learning models, we will provide notice and, where required, obtain your consent.

Your content, your rights. Your rights and obligations regarding User Content — including any license you grant to PointShot — are governed by our Terms of Service. You can delete individual videos and files through the Service, and you may request deactivation or deletion of your account as described in Section 10.

Sensitive content warning. User Content may reveal information about individuals that could be considered sensitive (for example, images of minors, biometric-style performance data, or health, nutrition, and training information). You are responsible for ensuring you have all rights and consents necessary to upload, share, and process any User Content you submit, including from any third parties who appear in it.

The Service includes a checkout through which you can purchase products and services from specialists (for example, paid sessions, plans, or subscriptions). Checkout is powered by Stripe; payouts to coaches and specialists are powered by Stripe Connect.

Information collected at checkout. When you make a purchase, we and Stripe collect information necessary to process the transaction, which may include:

  • Billing name and billing address.
  • Email address and, in some cases, phone number.
  • The product or service purchased, quantity, currency, and amount.
  • Limited payment method details (such as card brand, last four digits, and expiration date).
  • Transaction identifiers, authorization results, and related metadata.
  • Coupon or promotional codes used, and any taxes and fees.

Stripe as merchant of record for payment processing. Stripe handles all merchant-side payment compliance for PointShot, including PCI-DSS-compliant collection, processing, and storage of payment card and bank data, merchant fraud prevention and validation, and related dispute and chargeback handling. For payouts to coaches and specialists, Stripe Connect handles the collection of tax and identity information and the related tax reporting (including issuance of IRS Form 1099 to eligible recipients). PointShot does not collect or store full payment card numbers on its own systems. Your use of Stripe is subject to Stripe’s terms and privacy policy; Stripe’s privacy policy is available at https://stripe.com/privacy.

Use of payment information. We use information collected at checkout to authorize and complete your transaction, issue refunds, detect and prevent fraud, manage chargebacks and disputes, provide receipts and customer support, recognize returning customers, and comply with tax, accounting, recordkeeping, and other legal obligations.

Saved payment methods. If you choose to save a payment method for future use, Stripe stores that payment method on our behalf and returns a token that we associate with your account. You can remove saved payment methods through your account settings.

Retention of transaction records. We retain transaction records as described in Section 8 and for any longer period required by applicable tax, accounting, and anti-fraud laws.

We and our service providers use cookies, pixels, software development kits (SDKs), local storage, and similar technologies (collectively, “Cookies”) to operate the Service, remember your preferences, analyze how the Service is used, and support marketing. Categories include:

  • Strictly necessary cookies: required to operate the Service, including for authentication, security (such as Cloudflare Turnstile), load balancing, and checkout.
  • Functional cookies: remember choices you make (such as language or region) and provide enhanced features.
  • Analytics cookies: help us understand how the Service is used (for example, Google Analytics and PostHog).
  • Marketing cookies: used, where applicable, to measure campaign performance and deliver relevant communications.

You can control Cookies through your browser or device settings, and through any cookie banner or preference center we provide on the Service. Disabling certain Cookies may affect the functionality of the Service.

We support the Global Privacy Control (“GPC”) signal where required by applicable law. If we detect a GPC signal from your browser, we will treat it as an opt-out of “sale” or “sharing” of personal information for users in jurisdictions that recognize GPC.

For more details, please see our Cookie Policy at https://www.pointshot.com/cookie-policy (if available) or contact support@pointshot.com.

We retain personal information for as long as necessary to:

  • Provide the Service and maintain your account.
  • Comply with our legal, tax, accounting, and regulatory obligations.
  • Resolve disputes, enforce our agreements, and protect legal rights.
  • Improve the Service through analytics and research.

Representative retention periods:

  • Active accounts: Retained while the account remains active.
  • Deactivated accounts: Retained in an inactive state until you reactivate, delete, or we determine the account is no longer needed, subject to any longer periods required by law.
  • Accounts pending deletion: If you initiate account deletion, your account enters a seven (7) day pending-deletion period during which the action may be reversed by logging back in and cancelling the deletion. After the seven-day period, deletion proceeds as described in Section 10.3.
  • Accounts terminated by PointShot: When PointShot terminates an account for policy violations or safety reasons, the account is marked for permanent deletion and deleted within thirty (30) days, subject to any legal holds or other retention obligations. The full rules governing suspension, termination, and appeals are set out in our Terms of Service.
  • Deleted accounts: Upon account deletion, most user-input data is permanently removed within a reasonable period. Some identifying information may be retained where tied to historical records (for example, team rosters, evaluations, completed transactions) or where retention is required for legal compliance, dispute resolution, fraud prevention, or enforcement of our agreements.
  • Videos and other User Content: Retained while your account is active or until you delete the content, subject to backup and legal-hold retention.
  • Transaction and payment records: Retained for the period required by applicable tax, accounting, and anti-fraud laws (typically seven years in the United States). Stripe may retain related records under its own retention practices as described in Stripe’s privacy policy.
  • Communications and support records: Retained for service quality, safety, and compliance purposes.
  • Aggregated or de-identified data: May be retained indefinitely.

When we no longer need personal information, we delete, destroy, or de-identify it in accordance with our retention and disposal procedures.

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal information, including:

  • Encryption of data in transit and, where appropriate, at rest.
  • Access controls, authentication, and role-based permissions.
  • Regular security assessments, monitoring, and updates.
  • Employee training on data protection and security.
  • Vendor due diligence and contractual safeguards.

No method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials. If you believe your account has been compromised, please contact us immediately at support@pointshot.com.

In the event of a personal data breach affecting your information, we will notify affected individuals and applicable regulators within the timeframes required by applicable federal and state breach-notification laws.

10.1 Accessing and Updating Your Information

Section titled “10.1 Accessing and Updating Your Information”

You can access and update much of your personal information directly through your account settings. If you need assistance, please contact us at support@pointshot.com.

You may temporarily deactivate your account through in-product controls. Deactivation will:

  • Suspend user-input data and make your profile inactive.
  • Retain account data for potential reactivation.
  • Maintain your profile’s connection to rosters, seasons, and team affiliations.
  • Preserve transaction history accessible to specialists with whom you have worked.

You can reactivate by logging back in, and your data will be restored.

You may request permanent deletion of your account through in-product controls or by emailing support@pointshot.com. When you request deletion:

  • Your account enters a seven (7) day pending-deletion period during which the action may be reversed. To cancel the pending deletion, log back in during this period and follow the prompts to cancel.
  • After the seven-day period expires, most user-input data is permanently removed within a reasonable period thereafter.
  • Some identifying information may be retained where tied to historical records (for example, team rosters and completed transactions) or where required for legal, tax, or anti-fraud compliance.
  • Transaction history and payment information may remain accessible to specialists for business recordkeeping.

You can opt out of marketing emails by:

  • Clicking the “unsubscribe” link in any marketing email.
  • Updating your communication preferences in your account settings.
  • Contacting support@pointshot.com.

Even after opting out of marketing, we may still send you non-marketing messages related to your account or our ongoing business relationship (for example, transaction confirmations, service updates, and security alerts).

See Section 7 for how to control Cookies. You may also set your browser to refuse Cookies or to indicate when a Cookie is being sent.

Depending on where you live, you may have additional rights under applicable law (see Sections 11 and 12). To exercise those rights, email support@pointshot.com. We may need to verify your identity before fulfilling your request, including by asking you to confirm information associated with your account. If we cannot verify your identity, we may be unable to fulfill your request.

You may also authorize an agent to make a request on your behalf. We may require the agent to provide proof of authority and may ask you to verify your identity directly.

Response timelines. We aim to respond to all privacy rights requests as quickly as possible and in accordance with applicable law. Unless a different period applies under the law governing your request:

  • For requests under the CCPA/CPRA, we will acknowledge receipt within ten (10) business days and provide a substantive response within forty-five (45) calendar days of receipt. This period may be extended by an additional forty-five (45) days with notice to you.
  • For requests under other U.S. state privacy laws, we will respond within the timeframe required by the applicable law (typically 45 days, subject to extension).

We will not discriminate or retaliate against you for exercising any of your privacy rights.

11. Notice to California Residents (CCPA/CPRA)

Section titled “11. Notice to California Residents (CCPA/CPRA)”

This section applies to residents of California and supplements the rest of this Privacy Policy. It is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”).

11.3 “Sale” and “Sharing” of Personal Information

Section titled “11.3 “Sale” and “Sharing” of Personal Information”

PointShot does not sell personal information for money. However, our use of certain analytics and advertising cookies and similar technologies may constitute a “sale” or “sharing” (for cross-context behavioral advertising) of identifiers and internet activity information under the CCPA/CPRA.

Your right to opt out of sale or sharing: You may opt out of the “sale” or “sharing” of your personal information by:

  • Using the “Do Not Sell or Share My Personal Information” link available in the footer of our website (if applicable).
  • Enabling the Global Privacy Control in your browser (we honor GPC signals where required by law).
  • Emailing support@pointshot.com.

We do not knowingly sell or share the personal information of consumers under 16 without the required opt-in consent.

We may collect limited categories of “sensitive personal information” as defined by CCPA/CPRA, such as account log-in credentials, precise geolocation (only if you choose to provide it), and, where applicable, certain identifier information collected by Stripe Connect in connection with coach or specialist payout onboarding. We use sensitive personal information only for the purposes permitted by the CCPA/CPRA without triggering the right to limit, such as providing the Service, preventing fraud, and ensuring security. You may nonetheless have the right to limit the use of your sensitive personal information; to do so, email support@pointshot.com.

Subject to certain exceptions, California residents have the right to:

  • Know what categories and specific pieces of personal information we have collected, the sources, purposes, and categories of third parties with whom we share it.
  • Delete personal information we have collected from you.
  • Correct inaccurate personal information.
  • Opt out of the sale or sharing of personal information.
  • Limit the use and disclosure of sensitive personal information.
  • Not be retaliated against for exercising these rights.

To exercise your rights, email support@pointshot.com or submit a request through any method we designate on the Service. We will verify your request as described in Section 10.6. Authorized agents may submit requests with proof of authority.

California’s “Shine the Light” law (Civil Code § 1798.83) permits California residents to request certain information about our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, email support@pointshot.com.

Residents of certain U.S. states — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Indiana, Tennessee, New Jersey, New Hampshire, Minnesota, Maryland, Nebraska, Rhode Island, and others that enact comparable laws — may have rights similar to those described above, including the right to access, correct, or delete personal information, to obtain a portable copy, and to opt out of targeted advertising, sale of personal information, and certain profiling.

To exercise these rights, email support@pointshot.com. We will verify your request and respond within the timeframe required by applicable law (typically 45 days, subject to extension where permitted). If we decline your request, you have the right to appeal by replying to our response; instructions and the grounds for our decision will be provided in our response, and you will also be informed of how to contact your state attorney general or equivalent regulator if you remain dissatisfied.

We do not use personal information for decisions that produce legal or similarly significant effects about you without human involvement.

The Service is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without verifiable parental consent.

Athletes under 13. For athletes under 13 who use the Service with verifiable parental or guardian consent:

  • We disable the public visibility of the athlete’s profile. Profiles of athletes under 13 are not publicly browsable or searchable.
  • The athlete may still upload videos and files for their own private use and for in-product breakdown or analysis (for example, in our video editor).
  • The athlete may still purchase services from coaches and specialists through our marketplace, subject to parental consent and any other restrictions we require.
  • We do not knowingly sell or share the personal information of children under 16 without the required opt-in consent.

Athletes ages 13 through 17. For athletes between the ages of 13 and 17:

  • A parent or legal guardian must provide consent for the athlete’s use of the Service.
  • Parents and legal guardians may review, update, or request deletion of their child’s information by contacting support@pointshot.com.
  • We take additional measures to protect minors’ privacy and safety, including limiting who can contact them on the Service and restricting the sale or sharing of their personal information.

Parent-administered accounts for minors. For any athlete under 18, a parent or legal guardian may hold full administrative access to the athlete’s account. With that access, the parent may:

  • Manage account settings and profile information on the athlete’s behalf.
  • Make purchases from coaches and specialists and complete checkout on the athlete’s behalf, in which case the parent’s billing and payment information is collected and associated with the transaction (see Section 6).
  • Upload videos, images, documents, and other User Content on the athlete’s behalf (see Section 5). The parent is responsible for ensuring they have the rights and consents necessary to upload and share that content, including consents from any third parties who appear in it.
  • Exercise the athlete’s privacy rights, including access, correction, and deletion requests, while the athlete is a minor.

Persistent parent connection after the athlete turns 18. When an athlete reaches age 18, administrative control of the account transfers to the athlete. A parent may remain connected to the account after that point only if the now-adult athlete elects to preserve the connection through in-product controls. The adult athlete can revoke the parent’s continued access at any time, and from that point forward the parent will no longer have administrative access, purchase authority on the athlete’s behalf, or the ability to upload content to the athlete’s account. The adult athlete alone is responsible for exercising privacy rights with respect to their own data.

If you believe a child under 13 has provided us with personal information without parental consent, please contact us at support@pointshot.com, and we will take appropriate steps to investigate and, if necessary, delete the information.

14. Service Availability and International Users

Section titled “14. Service Availability and International Users”

The Service is offered from and intended for use by individuals located in the United States and is not directed to or offered to individuals in the European Economic Area, the United Kingdom, Switzerland, Canada, or other jurisdictions outside the United States. If you access the Service from outside the United States, you do so on your own initiative and acknowledge that your personal information will be processed in the United States, which may have data protection laws that differ from those of your country of residence.

The Service may contain links to, or integrations with, third-party websites, applications, or services that we do not control (for example, social media platforms, sports organizations, or partner sites). This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party websites or services you interact with. We are not responsible for the practices of those third parties.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by:

  • Posting the updated Privacy Policy on the Service with a new “Last Updated” date.
  • For significant changes, sending email notifications or providing a prominent notice on the Service.
